You can create your own evidence by depositing the cheque in the bank and getting them dishonored. Once the cheque returns, send them a legal notice asking them to pay the amount within the 15 days from the receipt of the notice. If they fail to to make the payment then you can file criminal case within 30 days under section 138.
CHEQUE BOUNCE “PAYMENT STOPPED BY DRAWEE”
I gave an amount of 15 lkhs to party. through online bank transaction. Party returned me 1.90 lkhs in 3 months span. further refund stopped. Party provided me signed filled cheque in its handwritting without date, Now party refused to repay amount. Says go and bounce cheque. i cannot give you money back. There is no any written agreement regarding this transaction. Just i transfered amount of 15lkhs through my online banking. Can i send notice and file case if this cheque gets bounced. How i will recover my money. Kindly advice.
