What is the DIR-3 KYC form?
The e-form DIR-3 KYC (Director’s KYC) mandates the KYC update in eForm DIR-3 KYC FOR ALL DIRECTOR’S, AND ALL PARTNERS/DESIGNED PARTNERS OF LLP. After company registration, all the directors must file the e-form DIR-3 KYC as soon as possible to avoid any obstacles in the operation of the business.

All the directors of companies who are either Indian nationals or foreign nationals are mandated to fill this form. If the DIN ( Director Identification Number) has be allotted on or before 31st of March 2018, and the status of the DIN appears as “Approved”, the KYC has to be updated by filing the DIR-3 KYC form on or before 15th of September 2018.
The date of filing the form has now been extended from 31st August 2018 to 15th September 2018.
What was the previous scenario of the filing of the form?
Before the latest notification, all the directors were required to file the DIR-3 KYC on or by 30th of April of every financial year, except for 2017-2018 where it was extended till 30th of August 2018, which is now further extended to 15th September 2018.

What are the consequences of not filing the DIR-3 KYC form?
According to the rule 12 A, non filing of the form will lead to cancellation of the DIN (Director Identification Number) of the director. The status of approval will be taken away and the DIN will be marked as “disqualified”
What are the consequences of filing the form after 15th September 2018?
If the form is filed after 15th of September, the deactivated DIN can be reactivated after the filing of the form and the payment of the prescribed fees under Rule 12A of Companies (Appointment and Qualification of Directors) Rules, 2014.
All the directors are subjected to a penalty of Rs. 5000 if the filing of the DIR-3 KYC form is done after 15th of September, 2018.
What documents are required for filing the DIR-3 KYC form?
The following documents are required by all directors, including the disqualified directors.
- A unique and personal mobile number duly verified by an OTP (one-time password)
- A personal e-mail ID duly verified by an OTP (one-time password)
- All Directors KYC documents such as
- A copy of PAN card
- Aadhaar card number
- Passport (if held)
- Copy of current address proof (bank statement or telephone bill)
The form should be filed by every Director using his own DSC and should be duly certified by a practicing professional (CA/CS/CMA).
Other important instructions regarding filing of the form :
- If the form is to be filed by a Foreign National Director, a passport is a mandatory document along with the list of documents aforementioned.
- It is mandatory for the form to be certified by a Practicing Chartered Account, Company Secretary or a Practicing Cost Accountant.
