The status of a trademark can be checked on IPINDIA website or via Company Vakil. A large number of trademarks are registered on a day to day basis as people are becoming more aware about protecting their trademark against fraud and preventing any other person from using the same. Registering a Trademark is of utmost importance as it gives uniqueness to the brand, protects the product name, protects the brand name, helps in the growth of the business, sets a brand apart from the crowd etc.
Hence while going through the registration process it becomes necessary to review the trademark stages in regular intervals. In this article we will learn the steps to check the status of a trademark on IPINDIA website.
The very first step in the trademark registration is filing a trademark application to the registrar of trademarks. The applicant has to select a trademark by conducting trademark searches and then after filing the application, the applicant is allotted an application number. This number helps the applicant to conduct a trademark detailed status check online on Government of India’s Website i.e. IP India Site or the trademark status Objected,Advertised or any other TM Status for whatso ever matter can also be checked at Company Vakil with help of their unique TM Search Algrythm.
The trademark officer next examines the applied trademark and issue an examination report. The officer can either accept or reject the application.
On receiving the application number the applicant must regularly check mark’s online status in order to make reply to the registrar in case of TM objection. If the trademark status search shows as objected the applicant must make a reply to the report within one month after receiving the examination report from the registrar, failure of which would result in abandonment of the trademark.

This was the whole procedure to view or check a Trade-mark. Now let’s understand the meaning of different mark status. The status of a trademark can vary from situation to situation. Different status means different meanings. The applicant must take actions to ensure smooth registration of the trademark.
If the trade marks status at the ipindia website shows as “New Application”, it means that the application has been entered into the database.
If the displayed status is “Send to Vienna Codification” it infers that the trademark is being assigned Vienna Codification.
If it reads “Formalities Check Pass”, it means that the trade-mark has passed all basic filing requirements and is ready for processing.
“Marked for exam” denotes the application is on the stage of examination by the examiner for acceptability.
“Objected” means the trademark application has been issued an adverse examination report by the trademark examiner. The trademark applicant has the option to address the objection raised.
“Exam Report Issued” infers that the trademark application is published in the Trademark Journal and is ready for oppositions from the public.
If the Trademark details shows as “Refused”, this would appear that the application has been refused on the basis of the applicant’s reply to the objection or report of the Registrar.
If the status reflects as “Advertised before acceptance” / “Accepted & Advertised” / “Accepted” it would imply that the trademark is published in the journal i.e. the official gazzette of the registry and is open for any 3rd party opposition for 4 months.
If the status displays “Opposed”, this would mean that the trademark is opposed on publication by a third party and the applicant must resolve the opposition’s concerns.
“Abandoned” purports that the applicant has not made replies or did not respond to the registrar on time.
“Withdrawn” would imply that the trademark application has been withdrawn by the applicant prior to registration.
“Removed” would mean that the trademark has been removed from the trademark registry. The mark is no longer trademarked.
“Registered” means that the applied trademark is accepted and is registered.
The process of registering a trademark may take between 8-24 months so it becomes important for the applicant to check mark status at regular intervals of the application process to respond to the concerns of the registrar which can be done at ipindia website.
