  • Examination by Copyright Office

The Registrar of Copyright examines the application and checks all the formal compliances. The copyright office takes note of all the particulars filled by the applicant. An application will be examined for 30 days of the publication. If during the examination, an objection is raised by any third party then the applicant will be given an opportunity to submit a written response for the objection raised. If the copyright examiner is satisfied with the written response then the application proceeds further otherwise in case of objection, an opportunity of hearing is given to the applicant.

  • Entry in Copyright Register of Registration

If there is no outstanding objection to the work, an entry is made to the copyright register of the registration and an extract of the same is sent to the applicant. The copyright granted will be valid for full term i.e. 60 years depending on the nature of the work. In case of literary and artistic works, the protection is valid for 60 years from the year following the death of the author whereas in case of cinematograph films and sound recordings, the protection is valid for 60 years from the date of publication.   1. Identity and the address proof of the author. This includes PAN card, Aadhaar Card, driving license, electricity bill, mobile bill etc. In case if the application is filed by someone other than the author, then the identity and address proof of the applicant is required.   2. Power of attorney signed by the author is required if the application is made by another person on behalf of the author.

The applicant must specify the relevant title of the work. In case of a website, he is required to provide the URL of the website.
