FOOD BUSINESS LICENSE VERSUS FOOD BUSINESS REGISTRATION

- Food Business License – State Government

PROCEDURE TO AVAIL FOOD LICENSE
Application for the licence must be submitted through Form B to the FSSAI Central or the State Licensing Authority, on the grounds of the eligibility criteria for the business accompanying the assigned registration fee. A self-attested FSSAI declaration and other prescribed documents should be included in the food business license.
A unique Application ID number will be provided to the person on submission of the FSSAI license on the portal. As in case if any additional documents are required, the FSSAI officer will form a query. Then after, in about 30 days, the applicant must furnish any additional information.
As soon as the information sent in by the applicant is approved, the FSSAI will issue the FSSAI registration certificate as an approval document.

However, if, there is no certain response under the prompt 7 days after submission or if no decision has been devised within 30 days, the Food Business Operator can start with the business provided that registration shan’t be disapproved without proving the applicant an opportunity.
VALIDITY AND RENEWAL OF FOOD LICENSE
On the basis of the amount paid, a license would stay valid for the next 1-5 years. The renewal of the license can be appealed through the Form A or Form B before 30 days of expiry date. Any late applications are subjected to a late fee of ₹100 per day, for each day if delay. If eventually, the license has expired, the operator has to stop all his/her business activities at the premises. Thus it is vital to all food business operators to ensure and track that their FSSAI license is valid.
SUSPENSION AND CANCELLATION OF FOOD LICENSE
In any case, if the operator somehow fails to follow the basic guidelines on sanitary and hygiene requirements, the FSSAI has the sole right to send an improvement notice. In the notice, a designed time period of 14 days will be provided to the business operator to work on the improvement aspects.
Finally if, the business operator still fails to cure the defects, the license will be cancelled and suspended. No compensation will be provided and the operator will have to cease everything. After 3 months, the operator can apply for a new fresh registration.
TRANSFER OF FSSAI LICENSE
If the FSSAI license holder deceases due to any cause, the license can be passed onto the legal representative or any family member. The latter must apply to the corresponding Authority to pass on the license to his/her favour. After verification, the application might be accepted or refused by the Authority. Nonetheless, the FSSAI can’t deny or overlook the request without responding the applicant without an opportunity of being heard and seen.
